FTC Fake Reviews Crackdown: A Warning for Brands

In recent months, the FTC took action against telehealth provider NextMed, alleging it misled consumers with deceptive pricing claims and used fake reviews to market weight loss medications. According to the FTC’s complaint, NextMed suppressed negative reviews on Trustpilot by selectively challenging critical reviews, offering Amazon gift cards to consumers to remove or change negative reviews, and by conditioning refunds on consumers’ agreement to remove negative reviews. In addition, the complaint alleges that the company generated fake positive reviews that were posted on Trustpilot and used testimonials and before-and-after photos from people who were not NextMed clients and had not used their products.  

Similarly, the FTC finalized an order against Rytr, a seller of AI testimonial tools, for providing fake review services to subscribers. The platform enabled sellers to publish fictitious positive reviews across major eCommerce marketplaces and business platforms, violating FTC rules and misleading consumers.

Together, these cases send a clear signal: fake reviews and manipulative marketing tactics are not a gray area – they are unlawful and clearly becoming enforcement priorities.

The FTC’s Fake Review Crackdown: Your FAQs Answered

As regulations tighten, many brands are asking what these changes mean in practice. Here are four important clarifications:

1. Are incentivized reviews illegal?

No, incentivized reviews are allowed if they meet FTC guidelines. Incentives must be clearly disclosed, and they cannot be conditional on a positive sentiment.

2. Do we need to publish every review onsite?

Brands can moderate reviews, but suppression is unlawful without a legitimate reason. According to the FTC reviews can only be rejected if they contain offensive content, false claims, spam, private information, or are proven fake. This is particularly true for reviews that were written by bonafide purchasers of the same product, which Yotpo’s technology automatically validates and marks as ‘verified buyer’ reviews, on any of our collection methods. Yotpo is designed to maximize the volume and coverage of these verified buyer reviews, and by design only verified buyer reviews are syndicated to Yotpo’s consumer facing partners, including social, search and retail channels. 

4. Are Yotpo’s Smart Prompts (AI-generated prompts to recommend topics for more impactful review collection) and similar AI capabilities a compliance issue?
